THE FOLLOWING SWEEPSTAKES IS VALID ONLY IN THE FIFTY (50) UNITED STATES AND DISTRICT OF COLUMBIA AND IS OPEN ONLY TO QUALIFIED PERSONS (AS DEFINED IN THE RULES BELOW) WHO ARE TWENTY-ONE (21) YEARS OF AGE OR OLDER AS OF THE DATE OF ENTRY. VOID WHEREVER PROHIBITED OR RESTRICTED BY LAW.  BY PARTICIPATING IN THIS SWEEPSTAKES, YOU AGREE TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF SPONSOR AND ADMINISTRATOR.  DO NOT PARTICIPATE IN THE SWEEPSTAKES IF YOU DO NOT AGREE TO THESE OFFICIAL RULES AND FALL WITHIN THE ELIGIBILITY REQUIREMENTS AS SET FORTH BELOW.

Sweepstakes Name:  Redneck Wines Nashville Weekend Getaway Sweepstakes (the “Sweepstakes”).

Sweepstakes Timing and Entry Period: The Sweepstakes begins at 12:00:01 a.m. Centeral Time (ET) on 4/01/2025 and ends at 11:59:59 p.m. CT on 5/15/2025 (“Registration Period”). Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void outside the (50) United States and District of Columbia, and wherever prohibited or restricted by law.

Eligibility – Who May Enter: Entries may be submitted by legal U.S. residents of, and who are located within, the fifty (50) United States or District of Columbia, who are age twenty-one (21) or older as of date of entry, and have a valid U.S. driver’s license or government-issued photo ID, except the following persons who are not eligible to enter, participate, or win:

1. Employees, officers, and directors of Redneck Wines, Inc. (“Sponsor”), Backwoods Marketing(“Agency”), Backwoods Marketing (the “Administrator”), and each of the foregoing’s respective owners, employees, contractors, parents, affiliated companies, subsidiaries, distributors, retailers, printers, advertising and promotion agencies, any and all other companies associated with the design or execution of this Sweepstakes, or any employees, officers, directors, members, shareholders or agents of any alcohol-beverage suppliers, retailers, distributors, importers, wholesalers or manufacturers, and the members of the immediate families or households, whether or not related, of any of the above. “Immediate family members” includes, for purposes of this Sweepstakes, parents (including in-laws), grandparents, siblings (including step-siblings), children (including step-children), grandchildren (including step-grandchildren) and each of their respective spouses, regardless of where they reside.

How to Enter – Two Ways:

1. Online Entry:  Find the registration link from a Sweepstakes related social media post from @Redneckwines, on Instagram, other online communication or press release, or by accessing the website directly by typing the following URL into your browser: www.redneckwinesusa.com/sweepstakes/nashville (“Sweepstakes Website”) during the “Registration Period.”  For clarity, a person may enter directly at the Sweepstakes Website.  After verifying your age, each entrant (also referred to herein as “participant”) must fully complete the online registration page with all required information including their name, valid email address, phone number (including area code), date of birth, state of residence.

1. Social Media Post:  Follow @Redneckwines on , Instagram to verify you are 21 years of age or over.  Find a Sweepstakes related post from @Redneck Wines, then comment on the post from your own account tagging at least one (1) friend that you know (21 years of age or older and who is interested in Sponsor’s Redneck Wines products; you are advised to obtain the friend’s consent before tagging them; the number of friends tagged in excess of one (1) will NOT improve your chances of winning) and use hashtags #redneckwines in your comment.  You must submit from your own Instagram account.  To enter the Sweepstakes via Instagram, you must be an active holder of an Instagram account.  If you do not have the Instagram application, you may download it through the application store on your mobile device. The Instagram application is free, and, Instagram user Terms of Use apply. Meta/Instagram, is not a Sponsor or in any way affiliated with this Sweepstakes.  If you enter using a mobile device on a wireless service provider’s network (as opposed to a Wi-Fi network), your carrier’s text and data rates will apply. You should consult your wireless service provider’s pricing plan for details. You agree to incur any and all charges demanded by your wireless carrier.

All entries must be fully complete and contain all required information and must be received by 11:59:59 pm CT on 5/15/2025 to be eligible. Maximum of one (1) entry per person, per entry method during the entire Registration Period for a maximum total of two (2) entries per person.

Any incomplete or ineligible entries, or any entry submitted with an invalid or fake or false email address or social media account, phone number or other incorrect information will be disqualified.  Released Parties (as defined below) are not responsible for lost, late, misdirected, illegible, incomplete, inaccessible, invalid, unintelligible, damaged, or for entries submitted in a manner that is not expressly allowed under these Official Rules, or for any entry not submitted or received due to any technical error or failure, unauthorized human intervention, inaccurate capture or mis-entry of any required information, or the failure to capture any such information for any reason including programming or technical errors, or effects of hackers or failure of any electronic equipment, computer or cellular transmissions and/or network connections; all of which will be disqualified.

Participants may opt-out of Email notifications at any time, without affecting their entry, by following the provided opt-out instructions. By participating and submitting an entry, the participant agrees that the Sponsor and participating parties are authorized to contact the participant via email, mail, phone, direct message on Instagram (if entering via Instagram ) or any other form of media to make participant aware of information pertinent to the Sweepstakes.  By opting into the Redneck Wines  during online registration, participant agrees that Sponsor may contact participant via email to distribute information regarding the Sponsor’s featured products, special events or promotional offers, or coupons. Participants may opt-out of any further email communication at any time by simply clicking UNSUBSCRIBE on any email message and following the provided opt-out instructions. Participants may also opt-out of any further email or mail communication at any time by submitting a request to [email protected].

Each participant must submit an entry on their own behalf.  Any entry submitted on behalf of another individual or using another person’s email address, Instagram account, or name, or providing any false email addresses or information, will be disqualified and ineligible to claim the Grand Prize. No joint, group or team entries are allowed. Once submitted, an entry cannot be amended or supplemented by participant. Any attempt by any Participant to obtain more than the stated number of entries allowed (that is, one [1] entry per entry method; two [2] entries in total) by using same, multiple/different emails, Instagram accounts, identities, or any other methods void all of that Participant’s entries and that Participant will be disqualified. No mechanically reproduced or automated entries are permitted. Use of any automated system to participate is prohibited and will result in disqualification and all such entries will be deemed void and the participant will be disqualified. False and/or deceptive entries or acts, including misrepresentation of age, shall render such entries ineligible. 

In the event of a dispute as to any entry, registration or submission, the authorized account holder of the email address or Instagram account used to register, and associated with the entry will be deemed to be the participant and they must be eligible according to these Official Rules. The “authorized account holder” is the natural person assigned an email address by an Internet access provider or Meta/Instagram online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Proof of being the authorized account holder may be required.

By registering to enter the Sweepstakes, you affirm that you have read and accepted the Official Rules of the Sweepstakes.  All entries received become the property of the Sponsor and will not be returned. Receipt of entry may be acknowledged, but any such acknowledgment is not otherwise binding upon Sponsor or Administrator under any legal theory. All participants agree to be bound by and abide by the Official Rules of the Sweepstakes.

Additional Social Media/Instagram Entry Requirements: Sponsor reserves the right to, in its sole and absolute discretion, disqualify any entry and/or submission for any reason that it considers to not be appropriate for the Sweepstakes.  Entry submission restrictions include, but are not limited to, the following requirements:

• may not include, depict or reference any individual under the age of twenty-one (21), or that appears to be under the age of twenty-one (21);
• not be, or ever have been, previously submitted in the Sweepstakes;
• except as relates to the Sponsor’s brand(s) or approved partners, not include trademarks, logos or copyrighted material not owned by the entrant or material that is used without permission (including, but not limited to, company names, photographs, works of art or images published on any media) or that otherwise infringes or violates the rights of any third-party (including, but not limited to, copyrights, trademarks, patents, trade secrets, logos, contract and licensing rights, rights of publicity or privacy, moral rights (i.e., “droit moral”) or any other intellectual property rights);
• not feature, display, refer to, or mention any companies or brands in competition with Sponsor;
• not include any unauthorized photos, images, comments or plagiarism of any kind;
• not depict or promote excessive or underage drinking, drugs, tobacco or firearms;
• not contain or reference nudity, inappropriate, indecent, sexually explicit, pornographic or obscene content or images (which shall be determined by Sponsor, in its sole and absolute discretion);
• not contain any political or politically themed or motivated messages, comments, statements or images;
• not defame, slander, libel, misrepresent or contain disparaging remarks or any other content that could adversely affect the name, reputation or goodwill of the Released Parties or any other individuals and/or entities affiliated or associated with Sponsor, the Sweepstakes or the prize, the determination of which shall remain in the sole discretion of Sponsor;
• not depict or include any comments, descriptions or images that may be considered unlawful, harmful, threatening, violent, abusive, harassing, tortious, defamatory, vulgar, libelous, invasive of another’s privacy, hateful, or racially, religiously, ethnically or otherwise objectionable in any manner as solely determined by Sponsor;
• not be subject to any third-party agreement or require payment or incurrence of any sums to obtain further permissions of any person or entity as a result of its use or exploitation of the comment(s), photo, idea or rights therein or portions, or modified versions or derivative works thereof;
• not include any name, likeness, description, photograph or any other identifying element, in whole or in part, of any person, living or dead, without permission;
• not depict or describe the mistreatment or abuse of animals; and,
• not depict or describe misuse or irresponsible use of Sponsor’s products or any other similar product;
• not depict, describe, imply or suggest that Sponsor’s products should be consumed in conjunction with driving a car, operating machinery or engaging in any other activity requiring dexterity or concentration;
• not depict or describe overconsumption or irresponsible consumption of alcohol.

Sponsor reserves the right, in its sole discretion, to disqualify any individual (and his or her entry) who tampers or attempts to tamper with or abuse the entry process or the Sweepstakes website and/or the @Redneckwines account page on Instagram in any way or who is otherwise in violation of these Official Rules, as determined by Sponsor or Administrator in their sole and absolute discretion. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY SWEEPSTAKES WEBSITE, AND/OR THE @REDNECKWINES ACCOUNT  PAGE ON INSTAGRAM , OR DEFRAUD SPONSOR OR ADMINISTRATOR, OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Winner Selection and Notification (1 Grand Prize Winner):  On or about 5/16/2025, a random drawing will be held to select a total of one (1) potential Grand Prize winner (see Grand Prize description below).  Provided that the content of the entry/submission is in compliance with these Official Rules, such content will not be taken into account in determining the potential Grand Prize winner. The potential winner will be notified initially by phone, social media direct message, and/or email beginning on or about 5/17/2025.  If the Administrator is unsuccessful in its attempt to reach and speak directly with a selected potential Grand Prize winner by phone within 24-hours of the initial notification attempt to the phone number, Instagram direct message or email address associated with that participant’s entry, then that participant may be disqualified and an alternate potential winner may be randomly selected from among the remaining eligible entries received and notified as per the procedures outlined above.  Note: Phone messages will not be left during the winner notification process.

During winner notification, the selected potential winner must confirm their eligibility and indicate their willingness and ability to travel during the designated travel timeframe and accept the Grand Prize.  The selected potential winner will then receive official notification via email delivery.  If the selected potential winner does not meet the eligibility requirements, or is unable or unwilling to travel during the designated travel timeframe, accept the Grand Prize or elects to decline the Grand Prize, said Winner will be disqualified and, at Sponsor’s discretion and time permitting, an alternate potential Grand Prize Winner will be randomly selected from among all remaining eligible entries and notified as per the procedures outlined above (time permitting).  Any disqualified participant or potential Winner will not receive any alternate prize substitution or compensation.  Decisions of the Administrator in the selection and determination of the Winner and all matters relating to this Sweepstakes are final and binding.

All of the following will apply to the Grand Prize winner: 1) Winner will be required to complete and return, within 3-days of date of receipt, a Grand Prize acceptance form, including an affidavit of eligibility and a liability/publicity release signed by both the winner and all of their travel guest(s), each of whom must be age 21 or older (publicity release where permitted) and a W-9 form (Grand Prize winner only);  2) Winner and their travel guest(s) will be required to present a copy of a valid driver’s license or passport as a condition of participating or receiving the Grand Prize;  and 3) Winner will be issued a 1099 form reflecting the value of the Grand Prize and is responsible for paying all applicable taxes (including, but not limited to all local, state and federal taxes) on such Grand Prize.  Failure to collect or properly claim any prize in accordance with these Official Rules will result in forfeiture of the Grand Prize.  If forfeited for any reason, said winner will not receive any other prize substitution or compensation, and the Grand Prize will remain the property of Sponsor and will not be awarded, except as provided herein.

Grand Prize (one (1) Grand Prize winner:  The eligible participant confirmed as the Grand Prize winner shall receive a trip for up to *two (2) (winner and one (1) verified guest, age 21 or older) to a domestic U.S. destination, based upon availability and maximum prize value.  The Grand Prize has a maximum retail value not to exceed $2,000, and includes:

• IF NECESSARY, up to *two (2) round-trip coach class airfare (for winner and one (1) verified guest, age 21 or older) from the nearest major airport to the winner’s home as designated by Sponsor to the Sponsor designated airport servicing the winner’s chosen destination.  Actual departure date, times, airline and airports based upon availability and the winner’s chosen destination and will be solely determined and designated by Sponsor. Winner and their guest(s) must travel together on same itinerary as set by Sponsor.  Maximum prize value not to exceed a total of $1,500.00 for all flights.

• • NOTE:  If a winner resides within 250 miles of the greater metro area of the winner’s chosen domestic U.S. destination, Sponsor reserves the right to award a $250 travel stipend in lieu of air transportation.

• One (1) $250 Hotel gift card for Grand Prize winner which may be used towards booking a hotel in Nashville.  Gift card subject to the hotel’s terms and conditions and gift card policy, (Receipt of gift card is contingent upon acceptance of other elements of Grand Prize.)
• Two (2) $150 VIP tickets to a Nashville bar for Grand Prize winner
• One (1) $100 gift card for food purchases for the Grand Prize winner which may be used towards travel expenses, from a gift card provider as solely determined and designated by Sponsor.  Gift card subject to the terms and conditions of the gift card policy from the issuing provider, including any expiration. (Receipt of gift card is contingent upon acceptance of other elements of Grand Prize.)

Flight arrangements will be provided by the Administrator and must be made a minimum of thirty(30) days prior to traveling except as otherwise provided by Sponsor/Administrator. Value of GrandPrize depends on origin and destination of trip.  Travel must conclude no later than 09/30/2025.  Total maximum Approximate Retail Value of the Grand Prize: $2,000.00.

Note:  Alcohol beverages are not part of the Grand Prize.  Actual departure date, times and mode of transportation are based upon availability and will be solely determined by Sponsor.  If a winner declines the designated travel itinerary or for any other reason cannot travel on the designated travel itinerary, winner will forfeit the Grand Prize and no other compensation or substitute Grand Prize will be made available.

If the winner entered via Instagram post, the tagged friend need not be one of his/her guests on Grand Prize trip.

*If winner accepts the Grand Prize with fewer than one (1) guests, the “extra” increments of Grand Prize will be forfeited, with no compensation or substitute prize being awarded.  Without limitation, in such case, Sponsor will only award flights to winner and each guest actually accompanying winner on the Grand Prize trip.

If any part of the Grand Prize is unused or declined by a winner (including winner and/or guest[s] not needing flights to the destination), no compensation or substitute prize element will be made available.  Winner and their guest(s) agree to comply with all applicable airline (or other transportation provider), rental property, and travel provider regulations in connection with the Grand Prize.  Winner and guest(s) shall be solely responsible for their behavior while traveling, must follow the instructions and direction from any travel provider or associated staff or security.  If winner or any of their guests violates the standards of the travel provider, behaves in an inappropriate, irresponsible, or offensive manner, or is deemed by staff or security to have violated any Official Rules, regulations or policy of the travel provider, or to be a security threat in any manner, said winner shall be ejected or denied entry, and shall immediately forfeit the remaining Grand Prize.

Winner must accept delivery of Grand Prize/Grand Prize-related material in the method as solely determined and designated by Sponsor. Grand Prizematerials shall be shipped only to the designated winner residential address as provided during winner notification, via the carrier as determined and designated by Sponsor (i.e. UPS, USPS or other Sponsor designated carrier), or as otherwise specified by Sponsor such as Will Call or e-ticket delivery to the email address or Instagram handle (as applicable) provided during registration and/or as provided during winner notification.

Once emailed, delivered, transferred via mobile delivery or shipped, Grand Prize shall be considered as awarded and delivered, and Sponsor shall not be responsible for actual receipt of delivery by winner.  Winner is solely responsible for any required software application for access to the Grand Prize award component.  Sponsor shall not be responsible for any lost, late, undelivered, misdirected, damaged or stolen delivery; or any incorrect delivery address or information provided by winner during registration or Grand Prize claim.  In the event of any delivery issues, including undelivered, misdirected, lost or stolen deliveries, Sponsor shall have no responsibility to replace the Grand Prize, and Grand Prize shall not be substituted by Sponsor with any alternate Grand Prize or compensation.  Winner shall look solely to designated shipper/carrier for any lost, damaged, stolen or mis-delivered packages and not to Sponsor for any delivery issues.

Sponsor will not be responsible for any travel or event delay, rescheduling, postponement or cancellation for any reason including but not limited to weather, pandemic, an Act of God, Force Majeure, government regulation or restriction, an act of terrorism (or threat of same), civil disturbance, work stoppage, or any other reason.  No substitute Grand Prize or compensation shall be provided by Sponsor in the event of any travel or event delay, rescheduling, postponement, or cancellation for any reason, and winner shall be subject to the terms and conditions of the airline ticket as applicable.

All ground transportation including airport and groundtransfers, parking, meals, gratuities, checked baggage fees, airline seat assignment fees, incidental expenses, applicable taxes (including, but not limited to all local, state and federal taxes) and any other expenses not specified herein as being included in the Grand Prize are the sole responsibility of winner and their guest(s).  Sponsor is not responsible for late, lost, damaged or stolen luggage.  It is recommended that winner and their guest(s) obtain sufficient personal insurance prior to departure.  Winner and their guest(s) hereby release Sponsor and Administrator from any duty to provide, check, or verify any and all necessary ID’s, passports, visas and tourist cards, birth certificates, vaccination certificates, and any other travel requirements (“Personal Documents”).  Sponsor shall not have any responsibility for the replacement of lost or stolen Personal Documents or passes, coupons, vouchers, receipts or other documents pertaining to the Grand Prize (“Travel Documents”) once the Travel Documents have been provided to winner.

Sponsor is not responsible for any travel delays, flight delays or cancellations or travel difficulty related to the Grand Prize, redemption or use.  If travel delays or difficulty prevent arrival in time for any and all elements of trip or Grand Prize, Sponsor is not responsible for awarding any compensation in lieu thereof.  Any changes to completed travel arrangements, once booked, are the sole responsibility of the Winner, and are solely at the Winner’s expense. Actual value of the trip will depend on point of departure, destination and any airfare fluctuations. If actual value of the Grand Prize is lower than the stated ARV of the Grand Prize when it is procured and fulfilled, then the difference will not be awarded to the winner.  Winner and their guest(s) are solely responsible for all costs incurred to and from the nearest major airport to the winner’s home as designated by Sponsor as the Grand Prize originates and terminates at such departure point unless otherwise agreed to by Sponsor in writing.

Winner and their guest(s) shall be subject to any qualifying conditions prior to and during travel, including any local, state or federal government regulations in the departure or destination location, airline and/or rental property requirements including any regulation or policy related to COVID-19 testing requirements or vaccination status. Any testing requirements, vaccination and/or any related quarantine requirements and expenses are the sole responsibility of, and at the sole expense of winner and their guest(s).  Winner and their guest(s) are subject to vaccination requirements and policy, and if unable or unwilling to comply with requirements, then all related Prize elements which they fail to meet shall be forfeited. Winner and their guest(s) further understand and agree that they must conduct themselves at all times in an appropriate and well-behaved manner prior to and during travel. Failure to do so may result in immediate termination of trip (and, if sufficiently egregious, without warning of any kind), with Released Parties not having any liability to said winner or their guest(s) under any legal theory; for clarity, termination of the trip is not the exclusive legal remedy available to Released Parties under such circumstances.

Upon request and without compensation other than the Grand Prize, Sponsor may require winner to provide photographs, video recordings and/or statements from/regarding the Grand Prize (“Grand Prize Content”), except where prohibited by law. To the extent applicable, winner transfers any and all of their rights, title and interest in and to the Grand Prize Content, including but not limited to any and all copyrights, trademark rights, “moral rights” and any and all other proprietary rights that may exist, throughout the world, to Sponsor (and its designees) and expressly waives any rights they may have in the Grand Prize Content. Winner agrees Sponsor is the exclusive owner of all rights in and to the Grand Prize Content and will have the worldwide, perpetual right to copy, display, reproduce, exhibit, edit, modify, assign, license, register for copyright or trademark, distribute, sell or otherwise use and exploit the Grand Prize Content and all elements and/or derivative works thereof, in whole or in part, alone or with other materials, in any media now known or hereafter created or devised, for any reason whatsoever. Winner further agrees to assist Sponsor upon request and without compensation other than the Grand Prize in obtaining any necessary consents and releases from other persons included in the Grand Prize Content.  Nothing herein in any way obligates Sponsor to either request or, if requested from and provided by winner, to use the Grand Prize Content; and, Sponsor’s decision not to request or use the Grand Prize Content from winner shall not result in any liability under any legal theory to such winner.

Additional Rules & Restrictions:  By participating, participants agree to abide by and be bound by the Official Rules and the decisions of the Sponsor and Administrator, which shall be final in all matters relating to this Sweepstakes.  In the event a participant wins the grand Prize and is later found to be in violation of these Official Rules they will be required to forfeit the Grand Prize or to reimburse Sponsor for the stated value of the Grand Prize if such violation is discovered after winner has used/redeemed the Grand Prize. Participation in the Sweepstakes constitutes permission for the Sponsor and its designees to use entrants’ names, cities and states of residence and/or likenesses for purposes of advertising and trade in any and all media now or hereafter known worldwide in perpetuity without limitation or compensation, notification or permission, unless prohibited by law.  False, fraudulent or deceptive entries or acts shall render entrants ineligible for the Grand Prize.

By participating, participants agree to hold all Released Parties harmless from any claims, losses, actions, or damages of any kind, whether actual, incidental or consequential, for injury (including but not limited to death), damages, losses or expenses arising out of or relating to participant’s participation in this Sweepstakes, or the acceptance, possession or use/misuse of the Grand Prize, or participation in Grand Prize-related activities (including but not limited to travel or activity related thereto), and to assume all liability therefor.

Participants are restricted to use of ordinary and typical consumer, business, or academic computer equipment, mobile phone equipment, Internet access and cellular networks. Sponsor disclaims all liability for the inability of a participant to complete or continue an entry due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond the Sponsor’s control, or otherwise. The Sponsor disclaims any liability for entries not received due to technical difficulties or transmission errors. The Sponsor disclaims all liability for any delays, mis-delivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method.  Released Parties are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant’s ability to participate in the Sweepstakes, and any injury or damage to entrant’s or any other person’s computer or mobile phone related to or resulting from participating in or downloading any information necessary to participate in the Sweepstakes.  Released Parties are not responsible for any attempted entries via Instagram post that are not received due to filtering or other operation of Meta/Instagram.  Released Parties are not responsible for any other errors of any kind, whether computer, technical, typographical, printing, human or otherwise, relating to or in connection with the Sweepstakes, including, without limitation, errors which may occur in connection with the printing or advertising of this Sweepstakes, administration or execution of the Sweepstakes, the cancellation of the Sweepstakes, the processing of entries or in the announcement of the Grand Prize or winner.  Sponsor, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Sweepstakes website.

Privacy Information:  Participants will be contacted using the phone number, Instagram account, and/or email address provided during the Registration Period.  Email addresses may be stored and entrants may receive email correspondence from, or on behalf of Sponsor subject to Sponsor’s privacy policy.  Sponsor uses commercially reasonable efforts to comply with Federal CAN-SPAM guidelines, and participants may subsequently opt-out of receiving further emails by following the opt-out instructions contained in the email.  Participant understands that he or she is providing their information to Sponsor. By entering the Sweepstakes, each participant acknowledges that his or her first and last name and hometown may be announced online, including on Sponsor’s social media channels (including but not limited to Instagram). Except where prohibited, acceptance of the Grand Prize constitutes consent by such winner to use of their name, voice, picture, likeness and biographical data for advertising and promotional purposes without any additional compensation or notice. Each participant further hereby acknowledges and agrees that if they are chosen as the winner for the Grand Prize, certain aspects of their identifying information may be disclosed to third parties (at least as required by law), including, without limitation, on an online page identifying the winner.  Information collected from participant will be treated by Sponsor in accordance with Sponsor’s privacy policy, available at https://redneckwinesusa.com/privacy-policy/, and with due regard to the participant’s privacy. Entrants should be aware that Sponsor may be collecting non-public, personally identifiable information about them in connection with the operation of the Sweepstakes. Entrants’ information will be hosted in the United States.

Additional Terms and Conditions: If, for any reason, the Sweepstakes cannot be executed as planned, including, but not limited to, any governmental order, force majeure, social media mandate, printing, administrative or other error of any kind, transmission failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Sweepstakes, or if the Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor reserves the right, in its sole discretion, to cancel, modify or terminate the Sweepstakes and, if terminated before the original end date, to select the winner from among all eligible, non-suspect entries received as of the date/time of termination. Notice of such action by Sponsor will be posted on Sweepstakes website and on @Redneckwines on Instagram.

No transfer or substitution of the Grand Prize (or any portion thereof) or cash redemption permitted, except as provided herein or at Sponsor’s sole discretion. (The preceding only excludes the Gift Card elements of Grand Prize where the ability of the holder to redeem a Gift Card for its cash value is mandated by law.)  Sponsor reserves the right to substitute a Grand Prize (or portion thereof) of equal or greater value in the event that advertised Grand Prize (or portion thereof) is unavailable for any reason. Sponsor further reserves the right, in its sole discretion, to offer a cash alternative for Grand Prize; however, the cash alternative may be less than the stated maximum ARV of the prize. All federal, state and local income taxes on the Grand Prize are the Winner’s sole responsibility. Winner will be issued an IRS Form 1099 for the value of said Grand Prize and agrees to fully cooperate with Sponsor and Administrator as to the compliance of Sponsor/Administrator with any reporting requirements of the Internal Revenue Service or any other tax authority, including by providing their Social Security Number or Tax Identification Number upon request. By accepting the Grand Prize, the winner waives the right to assert as a cost of winning said Grand Prize, any and all costs of redemption or travel to redeem said prize and any and all liability that might arise from redeeming or seeking to redeem said Grand Prize.

All other costs and expenses related to Grand Prize acceptance, delivery, redemption or use not specified herein as being provided are the sole responsibility of winner. The Grand Prize is awarded as is, without any warranty, express or implied, by Sponsor.  Failure to collect or properly claim Grand Prize in accordance with these Official Rules will result in forfeiture of the Grand Prize.  If forfeited for any reason, participant will not receive any other prize substitution or compensation, and the Grand Prize will remain the property of Sponsor and will not be awarded, except as provided herein.  Grand Prize will be awarded if properly claimed.  If unclaimed, Grand Prize will not be awarded.

SPONSOR’S DECISIONS AS TO THE ADMINISTRATION AND OPERATION OF THE SWEEPSTAKES AND THE SELECTION OF THE POTENTIAL WINNER ARE FINAL AND BINDING IN ALL RESPECTS. A PARTICIPANT IS NOT THE WINNER OF THE GRAND PRIZE UNLESS AND UNTIL THEIR ELIGIBILITY AND THE POTENTIAL WINNING ENTRY HAS BEEN VERIFIED AND PARTICIPANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. NEITHER SPONSORNOR ADMINISTRATOR WILL ACCEPT SCREEN SHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS. ANY ENTRY THAT OCCURS AFTER THE SYSTEM HAS FAILED FOR ANY REASON IS DEEMED DEFECTIVE AND IS VOID AND WILL NOT BE HONORED. PARTICIPATION CONSTITUTES PARTICIPANT’S FULL AND UNCONDITIONAL AGREEMENT TO THESE OFFICIAL RULES.

Releases: By entering or accepting the Grand Prize (if awarded to him/her), participant agrees to indemnify, release, defend and hold harmless the Sponsor, Agency, Administrator, their respective parent companies, subsidiaries, affiliates and agencies, and the officers, directors and employees of each of the foregoing as well as Meta Platforms, Inc. (collectively, the “Released Parties”), from and against any and all liability for any claims (including but not limited to third-party claims) arising from or relating to loss, harm, damage, injury, cost or expense whatsoever including, without limitation, claims alleging property damage, personal injury (including without limitation emotional distress) and/or death, violation of publicity rights, defamation or invasion of privacy that may arise from or in connection with participation in the Sweepstakes, including but not limited to,  winner’sSweepstakes entry; use of  winner’s name, likeness, biographical information, signature, image or likeness; winner’s receipt, possession, acceptance, use and/or misuse or inability to use the Grand Prize or part thereof or participation in Grand Prize-related activities, including, but not limited to, injury or loss sustained in any travel related to the Grand Prize; financial claims; physical and/or emotional injury; and/or any other legal claim that may arise, whether under contract, tort, warranty or any other theory or claim.

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of the Grand Prize. No more than the stated number of Grand Prizes will be awarded (i.e., one (1) Grand Prize). In the event that production, technical, seeding, programming or any other reasons cause more potential winners to be notified than the stated one (1)Grand Prize, only one (1) prize will be awarded via random drawing as set forth above among all legitimate, un-awarded, eligible prize claims. Construction: In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.
